Terms of Service

These Terms of Service ("Terms") govern your use of https://lifeacademystudy.com/ and the online preparation and mock test platform available through it (together, the "Platform"), operated by Learning Institute for Further Education Private Limited, trading as LIFE Academy ("LIFE Academy", "we", "us", "our"), VAT No. 621683622, of Chetana Tole, Bharatpur 12, Chitwan, Nepal.

By creating an account, purchasing any product, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

Please read Section 6 carefully. Fees are not refundable once paid.

1. Definitions

"Services" means the mock tests, practice materials, courses, classes, automated scoring, feedback and any other product we make available through the Platform.

"Content" means all questions, audio, reading passages, role-play cards, sample answers, videos, slides, blog articles and other material we provide.

"Your Submissions" means anything you produce or upload, including written answers, voice recordings and messages.

"Account" means your registered user profile on the Platform.

2. Eligibility and accounts

2.1 You must be at least 16 years old to hold an Account. Candidates aged 13 to 15 may use the Platform only through an account created and supervised by a parent or guardian, who accepts these Terms on their behalf.

2.2 You must give accurate registration information and keep it current. Accounts registered with false details may be suspended without refund.

2.3 Your Account is personal to you. You may not share your login, sell or transfer your Account, or allow anyone else to use it. Sharing credentials is the most common reason we close accounts, and it is a breach of these Terms.

2.4 You are responsible for everything done under your Account and for keeping your password confidential. Tell us at admin@lifeacademystudy.com immediately if you suspect unauthorised access.

2.5 We may refuse registration, or close any Account, at our discretion where these Terms have been breached.

3. What we provide, and what we do not

3.1 LIFE Academy provides preparation and practice services for the OET, IELTS, PTE and TOEFL examinations.

3.2 We are not an examination board. We do not administer official examinations, we do not issue official results, and we cannot register you for an official test sitting. Nothing you receive from us has any standing with any examining body, regulator, university, employer or immigration authority.

3.3 Trade marks and affiliation. OET is a trade mark of Cambridge Boxhill Language Assessment. IELTS is jointly owned by the British Council, IDP: IELTS Australia and Cambridge University Press & Assessment. PTE is a trade mark of Pearson. TOEFL is a trade mark of Educational Testing Service. We use these names only to describe the examinations we prepare candidates for. Except where we hold a current OET provider accreditation, which we state on the Platform, we are not endorsed by, affiliated with, or acting as an agent of any of these organisations.

3.4 Practice scores are estimates. Scores, bands and feedback produced by the Platform, whether generated automatically or by our teachers, are preparation guidance only. They are not predictions and carry no guarantee of correspondence with your official result.

3.5 No guarantee of outcome. We do not promise that you will pass any examination, achieve any particular score, obtain registration with any regulatory body, secure a visa, or gain admission to any institution. Any pass rates, testimonials or statistics we publish describe past cohorts and are not a promise about your result. Your outcome depends on your own preparation, ability and circumstances.

4. Automated scoring

4.1 Some Services use artificial intelligence to mark your writing and speaking and to generate feedback. No human reviews every submission.

4.2 By using these Services you consent to Your Submissions, including voice recordings, being processed by third party AI providers outside Nepal. See our Privacy Policy for detail.

4.3 Automated feedback can be wrong. It may misread handwriting-style errors, unusual phrasing, accents or background noise. Treat it as a study aid, not a verdict.

4.4 You may request human review of any automated score by writing to admin@lifeacademystudy.com. Availability of human review depends on the package you purchased.

5. Classes, bookings and scheduling

5.1 Class timetables, live sessions and speaking role-play appointments are subject to availability.

5.2 We may reschedule a class or change an instructor where necessary. Where we cancel a session outright and cannot offer a replacement, we will extend your access by an equivalent period.

5.3 If you miss a booked live session or speaking appointment without notice, it is treated as delivered and is not repeated or credited.

5.4 Cancellation notice periods, where they apply to your package, are stated at the point of purchase.

6. Fees, payment and refunds

6.1 Prices are shown on the Platform at the point of purchase and are payable in advance. Prices may be quoted in Nepalese Rupees or another currency depending on your payment method.

6.2 You are responsible for any bank charges, currency conversion costs, wallet fees or taxes imposed by your payment provider or your country.

6.3 Access to a purchased product begins immediately on successful payment, or on the start date stated for scheduled courses, and lasts for the validity period shown at purchase. Access expires at the end of that period whether or not you have used the material.

6.4 ALL FEES ARE NON-REFUNDABLE. Once payment has been made, it is not refundable and not transferable to another person, in whole or in part. This applies in every case, including but not limited to:

• you change your mind, or no longer wish to continue
• you do not attend classes, or stop attending part way through
• you do not use, or only partly use, the mock tests or materials you bought
• you do not achieve your target score or fail an official examination
• your visa, registration or job application is refused
• you are unable to sit your official examination for any reason
• your circumstances change, including travel, illness, employment or family reasons
• your Account is suspended or closed because you breached these Terms

6.5 By completing a purchase, you request immediate access to digital content and you acknowledge that you lose any right of cancellation or cooling-off period that would otherwise apply once access has been granted.

6.6 What we will do. Where we are at fault, we act. If we cancel a course outright and cannot deliver a replacement, if you are charged twice for the same product in error, or if a technical failure on our side prevents you from accessing what you paid for and we cannot fix it, contact us at admin@lifeacademystudy.com and we will resolve it, normally by restoring access, extending your validity period, providing a credit, or refunding the affected amount. This paragraph is limited to those situations.

6.7 Nothing in this Section removes any right you have under mandatory consumer protection law that cannot be excluded by agreement.

6.8 Chargebacks or payment disputes raised without first contacting us will result in immediate suspension of your Account.

7. Acceptable use

You must not:

• copy, record, screenshot, download, republish, resell or distribute any Content, whether for profit or not
• share your Account or let another person sit a mock test on your behalf
• reproduce or reconstruct our test items for use elsewhere, including on other websites, in coaching centres, or in study groups
• attempt to obtain answer keys or scoring rubrics by any means other than as provided
• use bots, scrapers, automated tools or bulk downloading against the Platform
• interfere with, probe or attempt to breach the security of the Platform
• upload anything unlawful, abusive, discriminatory, obscene or infringing
• harass or abuse our teachers, staff or other students, in class or in any channel
• misrepresent your identity or your relationship with LIFE Academy

Breach of this Section may result in immediate closure of your Account without refund, and where appropriate, referral to the police or to the relevant examining body.

8. Intellectual property

8.1 All Content on the Platform, together with the Platform itself, its design, code, branding and the LIFE Academy name and logo, belongs to us or our licensors and is protected by copyright and trade mark law.

8.2 On purchase, you receive a personal, non-exclusive, non-transferable licence to use the Content for your own examination preparation for the duration of your access period. That is all. No other rights are granted.

8.3 You may print or save material for your own study. You may not share it with anyone else or use it in your own teaching.

8.3A Protected copies. Premium downloadable papers or other protected exports may include the LIFE Academy ownership mark and a short, privacy-reviewed enrollment reference. The reference is designed to identify the enrolled account to our administrators if a copy is shared; it does not contain your name, email address or contact details. It may remain visible in printed or forwarded copies, so do not share your personal copy.

8.4 Your Submissions remain yours. You grant us a licence to store, process, mark and analyse them so that we can deliver the Services, and to use them in anonymised form to improve our materials and scoring. We will not publish anything identifying you without your written permission.

9. Availability

9.1 We aim to keep the Platform running but do not guarantee uninterrupted or error-free access. Maintenance, updates, power cuts, internet outages and third party failures happen.

9.2 We may modify, suspend or withdraw any part of the Services. Where a change materially reduces something you have already paid for, we will extend your access or provide a credit.

9.3 You are responsible for your own device, internet connection, microphone and browser. Mock tests, especially Listening and Speaking, require a stable connection. We are not responsible for attempts lost to your connection dropping, though we will normally restore an affected attempt on request.

10. Suspension and termination

10.1 You may stop using the Platform and ask us to close your Account at any time by emailing admin@lifeacademystudy.com. Closure does not entitle you to a refund. See Section 6.

10.2 We may suspend or close your Account immediately, without refund, if you breach these Terms, if we reasonably suspect fraud or credential sharing, or if your conduct harms other students or our staff.

10.3 On closure, your access to Content ends. We retain your data in accordance with the retention periods in our Privacy Policy.

11. Limitation of liability

11.1 Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

11.2 Subject to 11.1, our total liability to you in connection with the Services is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

11.3 We are not liable for indirect or consequential loss, including loss of earnings, lost employment or study opportunities, visa or registration refusals, examination fees, travel and accommodation costs, or loss of data.

11.4 We are not liable for the acts of any examining body, regulator, immigration authority, employer, education agent or third party.

12. Indemnity

You agree to indemnify us against any claim, loss or cost arising from your breach of these Terms, your misuse of the Platform, or your infringement of anyone else's rights.

13. Third party links and services

The Platform links to external sites, including exam boards, nursing and medical councils and immigration authorities. We do not control them and are not responsible for their content, accuracy or practices. Information we publish about registration processes and visa requirements is general guidance, believed accurate when written, and is not legal or immigration advice. Verify everything with the relevant official authority.

14. Privacy

Our Privacy Policy explains how we handle your personal information and forms part of these Terms.

15. Changes to these Terms

We may update these Terms. The date at the top shows the current version. Material changes will be notified by email or by notice on the Platform at least 14 days in advance. Changes do not apply retrospectively to purchases already made. Continued use after the effective date means you accept the revised Terms.

16. General

16.1 Entire agreement. These Terms, together with the Privacy Policy and any package-specific terms shown at purchase, form the whole agreement between us.

16.2 Severability. If any provision is found unenforceable, the rest remains in force.

16.3 No waiver. If we do not enforce a provision, we do not give up the right to enforce it later.

16.4 Force majeure. We are not liable for failures caused by events beyond our reasonable control, including natural disaster, earthquake, flood, epidemic, strike, bandh, civil disturbance, government action, or failure of power or telecommunications networks.

16.5 Assignment. You may not transfer your rights under these Terms. We may assign ours as part of a business transfer.

16.6 Governing law and jurisdiction. These Terms are governed by the laws of Nepal. The courts of Chitwan District, Nepal, have exclusive jurisdiction over any dispute, subject to any mandatory right you have to bring proceedings in your country of residence.

16.7 Complaints first. Before taking any formal step, contact us at admin@lifeacademystudy.com. Most matters are resolved directly.
